DIYBOOKING is an online platform that allows users to discover venues where concerts or music events are hosted, leave reviews and ratings, submit booking requests (where the service is available), and purchase advertising placements (“ads”) on the Platform.
DIYBOOKING does not sell tickets and does not organize events. The Platform exclusively provides intermediation, promotion, and communication facilitation services between users and venue owners.

Accept conditions
By using the DIYBOOKING website (hereinafter referred to as the “Platform”), you agree to comply with these Terms and Conditions, the Privacy Policy, as well as any other policies published by DIYBOOKING.
By using the Platform, users understand and agree that it acts solely as an intermediary and promotional service for venues and does not constitute a legal contract between users and the website operator, nor between the venue owner and the person making the reservation. Payments may be processed through the Platform on behalf of venue owners. DIYBOOKING acts exclusively as an intermediary and is not a party to the service contract between the user and the venue owner.
The Platform does not assume responsibility for the amounts paid, the booking conditions, or any disputes that may arise. Only properties marked as “verified” undergo a minimum validation process; however, even in these cases, we cannot provide absolute guarantees and do not assume responsibility for the services actually provided by the venue owners. We nevertheless recommend booking only verified venues.
DIYBOOKING does not set the commercial policies of the venues and does not guarantee refunds of amounts paid. In the event of disputes regarding refunds, the user must contact the venue owner directly.
These Terms and Conditions constitute the contract between the user and the Platform Operator, The Intermission SRL. By using the Platform, the user confirms that they have read, understood, and accepted this contract.
3. DIYBOOKING Status. Intermediary Role
DIYBOOKING acts exclusively as an intermediary and digital services provider.
Users understand and agree that:

DIYBOOKING is not a party to the contract between the user and the venue owner;

bookings and commercial terms are set exclusively by the venue owners;

payments may be made directly between the parties or processed through the Platform on behalf of the venue owners;

DIYBOOKING does not guarantee the services provided by venues and is not responsible for their performance.
Eligibility
The Platform is intended for:

natural persons aged at least 18 years;
-
legal entities, regardless of their legal form.
By using the Platform, the user represents and warrants that they have full legal capacity to enter into binding agreements.
Accounts, Roles, and Venue Verification
Users may create accounts in order to:

submit booking requests;
-
publish reviews;
-
request to manage (“claim”) a venue listing.
Venue owners will be granted this role only after manual approval by the Platform Operator.
Only venues marked as “verified” may display the contact and booking modules.
DIYBOOKING reserves the right to approve or reject any claim or listing requests.
User account
To leave reviews or make bookings, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
The user represents and warrants that they have the legal right to use the Platform and assumes full responsibility for their choice of venues, making bookings, and interactions with venue owners. DIYBOOKING shall not be held liable for any decisions made by users based on the information available on the Platform.
DIYBOOKING reserves the right to suspend or terminate accounts that violate these Terms, use the Platform for illegal or abusive purposes, or negatively affect the operation of the Platform or the experience of other users.
Reviews and User-Generated Content
Users may publish reviews, ratings, and comments regarding venues. The content must be original, respectful, and must not infringe the rights of others. DIYBOOKING reserves the right to remove any content deemed inappropriate, illegal, abusive, or false.
Reviews
Certain venues allow bookings to be made directly through the Platform. Bookings are subject to each venue’s individual policies (cancellation, refunds, modifications, etc.). DIYBOOKING acts solely as an intermediary and is not responsible for the services actually provided by venues or for the payments made.

Advertising (Ads) and Payment Processing
Venue owners and partners may purchase advertising placements on the Platform.
DIYBOOKING does not guarantee any specific volume of traffic or bookings as a result of advertising campaigns.
Payments made through the Platform are processed by third-party payment service providers (e.g., Stripe). DIYBOOKING does not store or process users’ card details. Any errors, delays, or issues related to payment processing are the responsibility of the payment processors, within the limits of applicable law.
Limitation of Liability
DIYBOOKING shall not be liable for:

the quality of services provided by venues;

changes, cancellations, or non-compliance related to events;

indirect damages, loss of profit, or loss of data;

technical errors, Platform unavailability, or failures of payment processors.
DIYBOOKING is not responsible for any misunderstandings or issues arising between users and venues, the accuracy or timeliness of information listed by venues, or any losses, damages, or harm resulting from the use of the Platform.
DIYBOOKING does not guarantee that booking requests will be accepted by venue owners and is not responsible for any refusal, cancellation, or modification of bookings by venue owners.
DIYBOOKING does not guarantee the continuous availability of the Platform, the absence of technical errors, or the absolute accuracy of the information provided by venue owners. The Platform shall not be liable for any indirect damages, loss of profit, loss of data, or other losses resulting from the use of, or inability to use, the Platform.
DIYBOOKING services are provided “as is” and “as available.” DIYBOOKING makes no express or implied warranties regarding the continuous operation of the Platform, venue availability, the success of bookings, or the achievement of any particular commercial results.
Protection Against Abuse and Fraud
Users agree to use the Platform in good faith.
DIYBOOKING reserves the right to suspend accounts or block access in cases of abusive, fraudulent, or illegal use.
Changes
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on the website and will take effect upon publication. Continued use of the Platform constitutes acceptance of the changes.
DIYBOOKING reserves the right to modify, suspend, or permanently or temporarily discontinue certain features of the Platform, without being liable for any resulting effects on users.
DIYBOOKING reserves the right to perform maintenance, updates, bug fixes, or technical changes to the Platform, which may temporarily result in service unavailability. Users agree that such interruptions do not give rise to any claims for compensation.
Intellectual property
All elements of the Platform (texts, design, logo, software) are the property of The Intermission SRL or its partners and are protected by copyright law.
Major force
DIYBOOKING shall not be held liable for any failure to perform its obligations due to force majeure events (including cyberattacks, natural disasters, actions by public authorities, or third-party service outages, etc.).
Data protection (GDPR)
The processing of personal data is carried out in accordance with the Privacy Policy, which forms an integral part of these Terms.
Applicable law
These Terms and Conditions are governed by the laws of Romania. Any disputes will be resolved by the competent courts of Romania.
Any official notice to DIYBOOKING must be sent exclusively by email to contact@diybooking.live. Communications via social media channels shall not be considered official notices.
